  • The bill released on Monday would establish a regulatory framework for most digital assets.
  • The market on market structure bill follows a failed attempt to adopt legislation similar to the last congress.

Four Republicans of the Chamber presented a bill on Monday which would establish a regulatory framework for digital assets in the United States.

If it is adopted, the cryptographic assets certified entirely “decentralized” would be classified as raw materials and would fall under the aegis of the Future Trading Commission commodities. The assets deemed centralized would be regulated by the Securities and Exchange Commission.

“Overall, this bill would again make the CFTC the dominant crypto regulator, but always gives the jurisdiction of the dry until a network establishes decentralization,” wrote Justin Slaughter, vice-president of regulatory affairs of the venture capital company of Crypto Paradigm, on X.

FRENCH HILL OF ARKANSAS, GT Thompson de Pennsylvania, Bryan Steil de Wisconsin and Dusty Johnson from the South Dakota co-wrote the discussion project. Discussion bills are intended for public comments and have not yet been presented in the legislative process.

“By providing strong guarantees and a regulatory certainty expected for a long time, the discussion writes the vision of President Trump to make the United States the” cryptographic capital of the world “and strengthens America’s leadership in the global financial system,” said Hill and Thompson in a statement.

The bill is a “progressive, although significant” rewriting of Fit21, a bill on the market structure which adopted the House of Representatives last year, according to Slaughter.

Financial innovation and technology for the law of the 21st century, or Fit21, had to end the “food struggle for control” of the regulation of cryptography between the SEC and the CFTC, according to one of the sponsors of the bill. He adopted the Chamber with important bipartisan support last year, but never received a vote in the Senate controlled by the Democrats.

The 212-page Monday pages discussion project also seeks to establish disclosure requirements for digital asset developers, a right to self-care cryptography, new consumer protections and state regulations for digital assets.

The committees of the Chamber of Agriculture and Financial Services should hold a joint audience on the legislation on the structure of the market on Tuesday.

The bill joins two other elements of cryptographic legislation which are currently making its way through the congress: the law on engineering and the stable law, which would both regulate the issuance of stablescoins pagayed in dollars.

The Senate engineering law has undergone a setback over the weekend after nine Democratic legislators have withdrawn, claiming that “the bill as it is currently has many problems that must be resolved”.
