A turning point for cryptocurrencies? Former SEC officials to testify against regulator in ‘blurry’ hearing

In a high-profile congressional hearing scheduled for September 18, 2024, former top executives of the U.S. Securities and Exchange Commission are set to testify against the agency. Titled “Dazed and Confused: Breaking Down the SEC’s Politicized Approach to Digital Assets,” the hearing will focus on the SEC’s controversial policies on cryptocurrencies, particularly under Chairman Gary Gensler.

This testimony would most likely provide insight into the perception of excess as well as the lack of clear and explicit guidelines for the crypto industry.

Witnesses and their reflections

Former SEC Commissioner Dan Gallagher and Michael Liftik, former deputy chief of staff to former SEC Chair Mary Jo White, are among the key witnesses.

Gallagher is now general counsel at Robinhood Markets, while Liftik is a partner at Quinn Emanuel Urquhart & Sullivan, LLP. The views of both individuals reflect internal events and decision-making at the commission during Gensler’s tenure.

Teddy Fusaro, president of Bitwise, will be one of the witnesses appearing before the committee. They will be joined by Jennifer Schulp of the Cato Institute. The testimony will focus, in many ways, on the broader impacts of SEC enforcement.

Gensler in the crosshairs

In recent years, the SEC’s enforcement actions against cryptocurrency companies have increased. Last year, the SEC announced a record number of enforcement actions, and critics vehemently claim that the agency is relying on a practice called “regulation by enforcement.”

Once again, this has left members of the crypto community frustrated and confused as companies try to navigate the murky waters of unclear regulation.

Beyond regulation, Gensler’s leadership is under review. House Republicans are investigating the SEC’s hiring practices for political bias, casting doubt on the agency’s independence. The probe has Gensler under pressure ahead of his congressional testimony this month.

Cryptocurrency regulation moves forward

Crisis hearing could change U.S. cryptocurrency regulation. With Gensler’s regulatory style and the SEC’s approach to digital assets under scrutiny, the testimony could change how cryptocurrencies are regulated.
