XRP SEC Classification Status: What It Means for the Markets

On March 17, 2026, the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) jointly released a regulatory framework that officially classifies XRP as a “digital commodity.” The designation, arguably the most significant regulatory pivot in the asset’s history, puts this month.

SEC Chairman Paul Atkins noted that the framework ends the uncertainty that has plagued the industry for a decade. By formally recognizing that the token’s value derives from network utility and supply and demand mechanisms rather than management’s profit expectations, the agency effectively validated Ripple’s long-standing defense.

The SEC Classification Framework: Where Does XRP Stand?

The new 68-page joint guidance goes beyond the piecemeal clarity provided by federal courts over the past three years. While U.S. District Judge Analisa Torres ruled in July 2023 that secondary sales of XRP were not securities, operational frictions related to the ambiguity of the “investment contract” remained for institutions. The new framework definitively lists XRP alongside 15 other assets as commodities, signaling that the network is sufficiently decentralized.

This alignment marks a radical departure from the SEC’s previous “regulation by enforcement” strategy. By ceding jurisdiction over the token’s asset status, regulators have eliminated the specter of future restitution penalties similar to those sought in the original 2020 complaint. For Ripple, this is not simply a moral victory but a structural relief valve.

Stuart Alderoty, Ripple’s chief legal officer, welcomed the clarity, crediting the SEC’s Crypto Working Group with finally aligning policy with market reality. The classification dismantles the legal basis for restricted exchange environments that have handicapped XRP’s liquidity in US markets relative to its global footprint. We suspect that after five years of litigation, the move to commodity status feels less like a triumph and more like a long-overdue correction.

Exchange lists and institutional access: the issues

The immediate downstream effect of commodity status is the reduction of risks associated with custodial services and stock market listings. Prior to 2026, compliance departments at major financial institutions considered XRP to be radioactive due to the continued threat of aiding the sale of unregistered securities. With the transfer of primary oversight to the CFTC, the compliance burden shifts from securities registration to commodity reporting – a much easier standard for the traditional financial industry to manage.

The market now includes a rapid acceleration in institutional product launches. Spot XRP ETFs, which have already seen $1.44 billion in cumulative inflows, face a March 27 final approval deadline for the latest batch of applications. Once commodity designation is obtained, the SEC has few statutory grounds to deny these filings, following the precedent set by the Bitcoin and Ethereum ETFs.

Additionally, this clarity reopens the conversation around a possible Ripple IPO. Without the securities disputes, Ripple’s path to the public markets appears much clearer, a move that would likely act as a secondary catalyst for the token’s valuation. Large asset managers no longer have to rely on complex trust structures for exposure.

XRP Price Dynamics: How Classification Risk Is Considered

Historically, XRP price action has been an indicator of regulatory sentiment, often diverging from broader market trends during key trading dates. Analysts now expect a move toward the $2.50 to $4.00 range as the “regulatory discount” evaporates. However, traders should curb their immediate enthusiasm; The overall macroeconomic environment remains hostile, with oil prices rising above $110 and geopolitical tensions dampening appetite for risky assets.

As the “XRP Army” anticipates vertical repricing, institutional accumulation will likely be more measured. The market structure suggests a rotation of capital rather than an immediate new injection of liquidity, especially as interest rates remain high. Current support levels are being tested against macroeconomic headwinds, meaning the “commodity premium” could take quarters, not days, to fully materialize on the chart.

Derivatives markets are already signaling a change in sentiment. We are seeing a restructuring of open positions as traders position themselves for the March 27 ETF deadline. Removing the label from securities reduces tail risk for market makers, which will likely result in tighter spreads and increased liquidity in U.S. portfolios.
