While the US government is approaching the end of the first day of a closure and the cryptographic industry is concerned about the delayed ETF approvals, an office on Capitol Hill still invoices the age of the cryptography of President Trump in order to obtain a bill on the structure of the market on his office by the end of the year.

Senator Cynthia Lummis (R-Wyo), president of the digital asset sub-comity and one of the main leaders in the negotiation of a bill on the structure of the cryptographic market in the Senate, responded to a survey on the question of whether the effects of a closure would slow down or drop this work. A spokesperson for the Lummis office replied by the text: “Senator Lummis continues to work on the legislation on the structure of the market; We are full. ”

Experts in cryptographic policy agree that if a closure has direct impacts on executive power, including the main regulators such as the SEC and the CFTC, the legislative power and its work, although silent, have in fact to determine the specific details of a bill. Ironically, the closure could eventually benefit from the increase in a bill on the structure of the market in 2025.

How a stop benefits the market structure

Summer Mersinger, CEO of the Blockchain Association and former CFTC Commissioner, explains how a closure of the United States government can really help Congress staff progress in legislation. Mersinger said: “It turns out that a lot of congress staff always end up working, but there are far fewer things … So in a certain sense, it frees the staff of the congress to perhaps work on things that they must clarify throughout the day. So, I am a little optimistic that it will give the people of the Senate to work on the structure of the market, a chance to put it in a way.”

Mersinger, also a former member of the leader of the majority leader in the Senate, John Thune (R-SD), explained how to try to do congress legislation as a staff member, it’s like trying to score basketball with a shooting clock “Time is always, now you want to do something, and it’s as if you have a stopwatch. Your opportunity to take the opportunity to expire.

Adam Minehardt, head of the public policy for Chainlink Labs, and a former member of Hill staff also, said that he was: “… hoping that the closure may really focus on the staff on the structure of the market”. According to Minehardt, certain offices of the congress move towards different working hours, will distance themselves or even close. Minehardt has highlighted meetings and access can be limited. “So, just a practical question, you may not have regular access to staff as you have done before. I think that all Hill’s staff, for the most part, will be considered essential, but where they work and how accessible they are is a different thing,” said Minehardt.

Mersigner stressed that, while she hoped that the closure would be over, Lummis and the Senatoric Banking Committee could have an increase in the bill even with an closure in place. According to Mersinger, the expectation of the movement on the structure of the market is currently within the Senatorial Agriculture Committee, which still has to share its draft legislation on the structure of the market. Senate AG has monitoring on the CFTC.

Market structure negotiations: Defining digital assets

Mersinger stressed that a fundamental question must still be calmed in the market structure bill. Mersinger described the question as one of the “… basic principles – how do you define digital assets, and what is security and what is a commodity – is always a live problem.” The Senate introduced a hybrid approach to how to define digital assets which was very different from the law on clarity adopted by the Chamber. Mersinger said: “It seems to be a simple solution, as you should simply be able to look at something and call (one token) one or the other, but the laws that make these determinations simply work for digital assets. So they (congress) will have to create a new test, and this test has been controversial.”

Minehardt said his hope that “… It would be a short closure and we can put things on the right track fairly quickly, because we think that all the ingredients are there. The White House was excellent. The treasure was excellent. Can get things back on the right track fairly quickly. “”

“Time is still now when you want to do something,” said Mersinger. My experience on the hill is still, if someone said, “We will do it later”, it meant that it was never going to happen, “she said.” At the moment, the opportunity is to do so while the momentum is strong. But the legislative shooting stopwatch is during the end of the year. »»

Bipartite momentum

Ji Kim, CEO of Crypto Council for Innovation, said that broader issues go beyond the slowdown in the Washington procedure. “Government closings harm American families, workers and businesses, and risk blocking bipartisan progress in the congress. We have seen significant measures on digital assets, and it is now the time to maintain this momentum for the structure of the market for consumers and American leadership.” Indeed, with the act of engineering adopting the congress in a largely bipartite way, then promulgated by Trump, seeing the Democrats working with the Republicans in the framework is critical and necessary for the Senate even examining a bill on the structure of the market. A dozen Democratic senators published their own version of a framework for a bill on the structure of the cryptographic market in September.

Mersinger confirmed that 2025 represents a critical window. “We have a good economy, the economy of digital assets is doing well and there is a real desire among the actors of this space to have the right federal framework in place,” she said. “If we are waiting for another crisis like FTX, this is when bad laws are written. It is now time to withdraw the best product in the congress.”
