The file meets a requirement set in July, when the parties asked the Court of Appeal to hold unanswered procedures while they sought to finalize the conditions of settlement.
This request follows a renewed request in the South New York district proposing to reassign a penalty of $ 125 million in Ripple, with $ 50 million going to the dry and $ 75 million in Ripple. Judge Analisa Torres, however, rejected the offer.
The dry and undulation are now awaiting the approval of their stipulation by the Court of Appeal to officially reject calls.
Once the dismissal has been granted, the case takes place to the application, forcing Ripple to satisfy the penalty of $ 125 million and to respect the conditions of the injunction, according to the SEC.
This result will leave the decision of judge Torres intact, under which XRP is not considered a guarantee in secondary trade, but certain institutional sales remain subject to securities.
