For years, the launch of a crypto project in the United States was a maze of uncertainty. The legal ambiguity and a hostile regulatory environment have pushed the founders offshore, transforming places like Switzerland and the Cayman islands into world hubs for the innovation of the blockchain.

With the election of Trump, things have finally started to change, an American administration openly declaring its intention to be crypto-amital. However, despite rhetoric, nothing concrete has changed so far.

The launch of a crypto project in the United States is just as difficult as ever. US regulatory agencies continue to offer only vague threats and “regulatory by application” prosecution. America wants to be a crypto leader, but even under the Trump administration, it does not act to create the conditions that would happen there.

Kill the crypto in America

Each crypto project is confronted with the same fundamental problem: the realization of decentralization is essential to avoid a regulatory examination, but until a project launches its token, a degree of centralization is inevitable.

The obsolete night’s Howey test guarantees that almost all legitimate crypto projects are classified as security. Logic is self-deficit. Projects cannot decentralize without launching a token, but the launch of a token in the United States instantly puts them in the DRI reticle.

It is not only a theoretical problem; He has real consequences. Liquidity suppliers, essential for all new token launches, will not engage with projects based in the United States because they assume that their tokens will be classified as titles. Centralized exchanges refuse to list the tokens emitted to American entities for the same reason. Even decentralized exchanges are faced with the pressure of their legal teams to avoid all of American projects. The result? The American founders are deposited from the global cryptography economy before even starting.

Offshore jurisdictions win

This regulatory failure has generated an entire industry of offshore legal firms specializing in the establishment of token entities. With its system of letters without Action Finma, Switzerland has become a home for Crypto projects because it offers one of the rare structured ways of clarifying legal on the classification of a token. The Cayman Islands and the British Virgin Islands have also established themselves as crypto safe paradise, providing flexible business structures that allow projects to operate with much less regulatory risks.

The absurdity is that real work – development, hiring, innovation – always occurs in the United States. The tokel program is pushed abroad via “associations” and “foundations”, which serve non-profit that operates independently of development stores based in the United States. The American founders are forced to channel money on unnecessary legal costs, operators abroad and shell foundations to avoid the inevitable repression of American regulators. It’s not just bad for crypto; It’s bad for America. Until it can be resolved, the United States will continue to hemorragize talents, investment and influence with less myopic jurisdictions.

Making America Crypto-friendly

The United States has spent years escaping Crypto’s policy, and now, even with an administration that claims to be Pro-Crypto, it still cannot make real changes. The solution is not to promise tax exemptions on capital gains on the crypto, as some have suggested. This is not much to improve the punitive regulatory landscape that projects based on the United States are forced to navigate. If the United States really wants to lead in crypto, this must also take the lead by providing regulatory clarity.

This ultimately means recognizing that the same regulations that have governed traditional financial markets cannot always be applied to the crypto. The Howey test does not work. Instead, the government must provide a new and functional legal framework for the cryptographic industry.

It is time for American legislators and regulators to recognize that cryptographic tokens cannot reach decentralization instantly and almost always require the efforts of a team of basic contributors to the initial growth and development of Bootstrap. The federal government must design a version of the Howey test which does not automatically classify each new cryptographic token as security but rather allows the tokens a period of grace to decentralize. In collaboration with this, the United States must establish new protections to ensure that initiates do not unduly benefit from cryptographic projects while it evolves.

In addition to putting an end to the “application regulation” approach used in the context of Gary Gensler’s dry approach, a tactic apparently designed to gradually suffocate cryptographic activity in the United States, the government must provide clear directives. It should be possible for market manufacturers to assess whether American tokens are products or securities with a degree of stability and predictability. This is the only way to put an end to the coverage prohibitions that market manufacturers have placed on American tokens and to bring back the development of cryptography in America.

The American opportunity window closes

The Crypto founders do not wait for Washington to understand it. Each day, without clear regulation, more cryptographic projects are incorporated abroad. The United States does not even need to “kiss” the crypto. He just needs to stop hunting him actively.

If this administration really wants to make the United States the leader of the crypto, it must go beyond campaign slogans and start solving the fundamental problems that forced this industry in offshore in the first place. And he must act quickly.
